Court Proceedings

Immigration court proceedings are legal processes that determine whether a person who is not a citizen or national of the United States can remain in the country or must be deported. A person who is in immigration court proceedings is called a respondent, and the government agency that initiates the proceedings is called the Department of Homeland Security (DHS). The immigration court is part of the Executive Office for Immigration Review (EOIR), which is an independent branch of the Department of Justice.
